By commissioning me, or purchasing my adoptable designs, you are agreeing to the terms of service below. Violating my TOS will result in Blacklisting [1] and automatic forfeit of your rights to the work.General TOS• The artwork is for personal use only. Artwork may be used as profile pictures, banners, etc, but may not be used for commercial use. Please contact me to discuss commercial rights as there will be additional fees.• I own all rights to the work. Putting my work into any A/I engine, using it to train A/I, turning them into N/F/Ts and the like is prohibited.Failure to adhere to this will result in blacklisting and loss of rights to the artwork.• Reposting and sharing the artwork is a-okay and encouraged! Just please credit me; @ALostFey.bsky.social. Please do NOT remove my watermark/claim the art as your own. This will result in blacklisting and a retraction of rights to the artwork.• Physical copies may be made for personal use only. My watermark/signature must NOT be removed from the physical copy.• Work will be posted on my social media, in my portfolio, and/or streamed unless requested otherwise.• Listed prices are the base price. The price may change depending on additional details and the complexity of the commission as stated on my commission sheet.• I have the right to decline a commission if I feel that my skill level may not meet your request, or if the request falls under subjects I will not draw.• Please be patient. I have a full time job, and the unexpected happens. I will contact you should anything come up, and I try my best to keep commissioners updated on the progress. You can reach out if it's been a minute, but please do not spam/harass me for updates.• I love visual references! Please have some on hand. Non-visual references may result in additional fees. • Extreme Body HorrorPayment Info• Payment is via PayPal only. An invoice will be sent by me. A deposit of at least 50% (NON-REFUNDABLE) must be paid before I start working. Once the sketch is approved, the remaining balance must be paid, in FULL before I continue working and finish your request.• If for some reason you need to cancel your commission after paying the 50% deposit but BEFORE the sketch has been approved, I can give a partial refund. (I will keep a minimum of 20% to cover services already rendered, and can send what was completed up to that point. If no work has been done yet a full refund can be made.)• Please be kind! Any aggressive, rude, or inappropriate behavior toward me during the process will result in me canceling the commission and blacklisting you. You will be refunded 50% of the total payment.Process• Upon starting, I will send progress images! I will send an initial messy sketch, which will be cleaned up for the sketch tier, and flat colors for your review. During this time is the BEST time to ask for revisions. After confirmation, no refunds may be requested and any additional revisions will incur a further 10% of full commission price per revision.• After the sketch and flat color steps are approved only minor (up to 3) revisions may be requested [2]. Major revisions or more than the allotted 3 will result in additional fees, especially if moved on to the rendering tier.• Once the artwork is finished, I will send you full res .png and/or .jpeg files of the work to a place of your choosing (ie DMs, email, etc) for social media posting. No physical product will be delivered.• From start to finish your commission should be completed within 2 to 3 weeks depending on workload/queue, unforeseen circumstances, etc. But, again, I am pretty good about vocalizing should timelines not line up accordingly.• Should you need your piece sooner, we can discuss how best to work around your timelines, however, this will result in an additional charge (rush fee).• Rush fees are at least +25% of the commission. Fees might vary depending on the project and the timeframe provided.• Estimated project start dates can be given upon request but cannot be fully guaranteed as it depends on workload.• Dates provided are subject to change, details are to be discussed should the client have set dates.Adoptable Design TOS• Terms of Service for Adoptable Designs are the same as commissions, stated above. With a few additions.• Adoptable designs are to be paid 100% up front unless a payment plan is discussed and agreed upon in advance. In which case the adopt’s files will not be transferred until full payment has been made.• Holds for Adoptables will last up to a max of 48 hours, failure to pay or begin a payment plan after the initial acceptance of your offer will result in the adoptable returning to the market for sale.• Minor changes and color variations are available upon request, up to 3, any more than that will result in additional fees or decline of sale. (see point 2 below)• You are allowed to resell/trade the adoptable, however, it cannot be for more than you originally paid for it. Please contact me with the new owner for my databases.• When trading or reselling adoptables, my watermark/claim MUST remain with the design. Please do NOT remove my watermark/claim the art/design as your own. This will result in blacklisting and a retraction of rights to the design.• Reposting and sharing is a-okay and encouraged! This list will be public and could result in others also declining your commissions.[2.] Minor revision examples; color alterations, small details.
